These Terms & Conditions apply to bookings at Te Whare Moana Escape, operated by Anna Jolly and Antony Tucker, trading as Te Whare Moana Escape. In these terms, “we”, “us” and “our” refer to the operators, and “you” and “the guest” refer to the person making the booking and the registered guests.
By completing a booking, you confirm that you have had the opportunity to read these Terms & Conditions and agree to them, subject to your rights under New Zealand law.
Bookings are subject to availability. A booking is confirmed once the required initial payment has been received and we have issued written confirmation.
The person making the booking is responsible for ensuring that all guests are aware of and comply with these Terms & Conditions throughout their stay.
We may request valid identification and a valid payment card to verify a booking.
A 50% deposit is required at the time of booking. The remaining 50% balance is due 15 days before arrival. For bookings made within 15 days of arrival, full payment is required at the time of booking.
Prices are stated in New Zealand dollars (NZD) and include applicable taxes.
If the outstanding balance is not received by the due date, we may contact you to arrange payment. If payment remains outstanding after reasonable notice, we may cancel the booking. Any refund will be assessed in accordance with the applicable cancellation terms and your rights under New Zealand law.
Where a refund is due, it will be processed to the original payment method where practicable. Any payment-processing fees that are genuinely non-refundable may be deducted from a refund to the extent permitted by law.
All cancellations must be submitted in writing. The date we receive your written cancellation request will be used to determine the applicable cancellation terms.
Our cancellation policy is:
We strongly recommend that guests arrange appropriate travel insurance to cover unforeseen circumstances that may affect their ability to travel.
These cancellation terms do not limit any rights or remedies available under New Zealand law.
Te Whare Moana Escape is a private cabin with a maximum occupancy of two guests. The accommodation is suitable for:
Guests under 16 years of age, including babies and infants, cannot be accommodated.
The maximum occupancy of two people must not be exceeded at any time, including during visits to the property.
One date change may be made without a change fee, provided the request is made more than 30 days before the original arrival date.
A date change is subject to availability, and the new dates must be within 12 months of the original booking.
If the new dates have a higher accommodation rate, the difference is payable by the guest. If the new dates have a lower accommodation rate, the difference will be refunded, less any applicable non-refundable payment-processing fees, to the extent permitted by law.
Only one date change is permitted per booking. Requests made 30 days or fewer before the original arrival date will not be accepted under this date-change policy.
If you change your booking dates, the original booking's cancellation deadlines and refund entitlements will continue to apply. A date change does not reset the cancellation period or create an additional entitlement to a refund. If you subsequently cancel, your refund will be assessed using the original arrival date and the applicable cancellation terms, subject to your rights under New Zealand law.
If we need to cancel a confirmed booking and cannot provide the accommodation, we will notify you as soon as reasonably practicable and refund all amounts paid for the affected booking.
We may offer alternative dates, but you are not required to accept them. This clause does not limit any rights or remedies available under New Zealand law.
Neither party will be considered at fault for a failure to fulfil their obligations where this is caused by an event beyond their reasonable control, such as a natural disaster, flood, earthquake, severe weather event, fire, government restriction or significant interruption to essential services.
If such an event prevents us from providing the accommodation for the booked dates, we will notify affected guests as soon as reasonably practicable. We may offer alternative dates, but guests are not required to accept them. If the accommodation cannot be provided, we will refund the amounts paid for the affected booking, subject to any rights or remedies available under New Zealand law.
If an event affects your ability to travel but we are still able to provide the accommodation, our usual cancellation policy will apply, subject to any rights or remedies available under New Zealand law.
Vehicles and personal belongings brought onto or left at the property are the responsibility of their owners. We recommend parking in designated areas and taking reasonable precautions during adverse weather, including high winds.
We are not responsible for loss of or damage to guests' vehicles or personal belongings caused by natural events, falling branches, falling trees, debris, severe weather or other circumstances beyond our reasonable control, except to the extent that we are liable under New Zealand law.
Guests should ensure that their vehicle and personal belongings are covered by appropriate insurance.
Check-in is from 3:00 pm on the day of arrival.
Check-out is by 11:00 am on the day of departure.
Early check-in or late check-out may be available by prior arrangement and is subject to availability. Additional charges may apply.
Te Whare Moana Escape is booked for the guests named on the reservation. Visitors are not permitted without our prior written permission.
Requests for visitors must be made in writing, and approval is at our discretion. Approved visitors may not stay overnight, and the maximum occupancy of two people applies at all times.
Te Whare Moana Escape is strictly pet-free. Pets and other animals are not permitted anywhere on the property.
Smoking and vaping are not permitted anywhere on the property.
Te Whare Moana Escape is intended as a peaceful private retreat. Parties, events, celebrations, gatherings and functions are not permitted.
Guests must behave respectfully and must not create excessive noise or disturbance that affects the property, neighbours or surrounding environment.
Te Whare Moana Escape has an outdoor wood-fired bath and outdoor fireplace. Their use is subject to all applicable Fire and Emergency New Zealand, local council and other fire-safety requirements.
Fire restrictions can change according to local conditions. Guests must comply with all applicable fire restrictions, safety requirements and instructions provided at the property.
We reserve the right to restrict or prohibit use of the wood-fired bath or outdoor fireplace whenever conditions make their use unsafe or when required by law.
The outdoor bath also has a gas-heating option, subject to availability and safe operating conditions, when wood firing is not permitted or practical.
Guests must never leave an outdoor fire unattended and must ensure that fires are completely extinguished after use.
Guests are responsible for the reasonable cost of repairing or replacing property that is damaged, broken, lost or removed during their stay, other than reasonable wear and tear.
Guests may also be charged for additional cleaning where the cabin requires cleaning beyond the normal cleaning required between guests. This may include excessive cleaning resulting from spills, food, mud, smoking, vaping or other misuse of the accommodation.
Guests are responsible for returning keys and other property belonging to Te Whare Moana Escape at the end of their stay. Reasonable costs associated with lost keys or replacement of locks or access devices may be charged to the guest.
Any charge for damage, loss or additional cleaning will be assessed reasonably and should reflect the actual cost incurred. We will provide an explanation and supporting details for any charge where appropriate. Any payment-card charge will be subject to applicable law and the relevant payment-card terms.
Electricity, water, internet and other services may occasionally be temporarily interrupted due to maintenance, equipment failure, weather or circumstances outside our reasonable control.
Minor or temporary interruptions do not automatically entitle guests to a refund. We will take reasonable steps to restore affected services as soon as practicable.
Where an interruption or unforeseen event substantially affects our ability to provide the accommodation, we will work with the guest to determine an appropriate resolution in accordance with these Terms & Conditions and New Zealand law.
Te Whare Moana Escape is located in a natural environment where weather conditions can change quickly. Rain, strong winds and other adverse weather conditions may occur during a stay and may affect access to or use of some outdoor facilities.
Certain facilities, including the outdoor wood-fired bath and fireplace, may need to be temporarily unavailable when weather or fire conditions make their use unsafe or when their use is prohibited by law.
Where reasonably possible, we will provide alternative arrangements or restore affected facilities when conditions permit.
Weather conditions that affect a guest's plans or enjoyment of their stay do not, by themselves, constitute grounds for a refund.
If an unforeseen event outside our reasonable control prevents us from providing the accommodation, we will contact affected guests as soon as reasonably practicable and work with them on an appropriate remedy in accordance with New Zealand law.
Guests are responsible for taking reasonable care of themselves, their belongings and the property during their stay, and for following any safety instructions provided at the property.
Guests must use the outdoor bath, fireplace and other facilities responsibly and follow all instructions provided.
